to ramp and 27-year-old johnnie hammar is nearing texas after being released from the prison and threats by cartel members amid terrible, terrible living conditions and great to be reunited. his father is now concerned for his health, unfortunately. and his mother describes him as being sick and he may have to go to the emergency room, the suspicion is, he could have bronchitis. the former marine's health has been a big concern during the whole four-month ordeal and previously spent months being treated for ptsd after a grueling combat experience in iraq and his lawyer says his being with the family is certainly helping, take a listen. >> and we have said that johnnie is innocent and always said it, and prove it, but, however, i believe in the next stage that you will see more

education to some laws and something, this should not have happened. >> reporter: doesn't look like any media appearances from john or the family just yet. they really want to get him back home, to their home in florida as soon as they can and it looks like it will have to be by car, john isn't in any condition to fly, they say. it took immense u.s. media coverage and pressure from the state department to get the mexican authorities to drop all charges against him. in the end they determined while it was illegal for him to have taken the gun into the the country, he never intended to commit a crime and it appears with the pressure of the the state department, and something of a face-saving compromise for the mexicans in order to get him released. jamie, back to you. >> jamie: on this one, dominic, chained to that bed for four months, that's a crime. we're so happy that johnnie will be home with his family where he belongs and i hope his health holds up, wish him the best. thank you, dominic. >> reporter: absolutely. >> kelly: president obama announcing the first member of his new foreign policy team on friday. nominating massachusetts

senator john kerry to become his next secretary of state, the move as the administration faces a host of pressing issues from the fallout over the september 11th terror attacks on the u.s. consulate in benghazi, to growing unrest in the middle east, as well as asia. our peter doocy has been following the story and live from washington. what are the details of the nominee? >> kelly, back in 2004, senator kerry let then state senator barack obama speak at his nomination, and it was a road to the white house. and yesterday at the white house president obama nominated kerry to be secretary of state in his second term. >> in a sense, john's entire life has prepared him for this role. as a son of a foreign service officer, he has a deep respect for the men and women of the the state department, the role they play in advancing our interests and values, the

risks that they undertake and the sacrifice that is they make along with their families. >> issues with iran, syria and north korea are the most pressing senator kerry will face if he's confirmed. yesterday, a long time colleague of his, senator john mccain congratulated him on his nomination and will consider that nomination, but he did not promise to support it. >> my view on whether secretary kerry should be-- or senator kerry should be secretary will not be based on differents of views. we had difference of views going back to 1991 when he said desert storm would fail. but what it will be based on is my view of his ability to carry out his responsibilities. >> reporter: we didn't hear from kerry yesterday. we also didn't hear from current secretary of state hillary clinton still recovering from the same concussion that kept her from testifying before congress about the deadly raid on the u.s. consulate in benghazi,

prayer for all our troops, especially those in afghanistan, who are spending this holiday season overseas, risking their lives to defend the freedoms we hold so dearly. >> jamie: we appreciate what they do. and in the republican address, house speaker john boehner focusing on a yet to be decided plan to avert the so-called fiscal cliff, saying it's now up to the president and democratically controlled nate senate to come up with a solution. >> what the president has offered so far simply won't do anything to solve our spending problems and our nation's crippling debt. instead he wants more spending and tax hikes that will hurt our economy and reduces the challenges of his party to deal honestly with the entitlement reform and the big issues that are facing our nation. that's why we find ourselves here today. >> jamie: there's just nine days left. can the lawmakers work out a deal before it's too late? angela mcglowan is a fox news

analyst and michael meehan ceo of ben square communications, and advisor to senator john kerry, quite a week for him. angela, before i talk to you, is whether or not a deal could happen before it's too late, is that question moot? >> no, it isn't, jamie. a deal can happen and i believe that a deal will happen. i'm going to make a statement that president obama made about being optimistic. i'm optimistic that they can cut a deal for what they need to stop doing is this political theater. they are he' still playing politics and this negotiation debacle is an example of how washington d.c. is broken, but i don't fault boehner, i fault president obama and the tea party. >> jamie: mike, at this point politically theater or not, the question is sitting on the edge of their seat. why is it going this way? why is the president away? why is john boehner saying it's up to the president? how do you see this whole thing playing out?

>> well, i think speaker boehner had a really tough day. if this were a parliamentary system they'd throw him out as leader. he went to the caucus and they said we're not going to follow along. he they got 95% of what they wanted on the tax, maybe 99% and he said, well, i'm going to punt my responsibility, kick it to the senate, to the president and hope they can figure it out. the congress has the power of the purse strings. they have the ability to cut and spend on what they want to spend upon and to hear the speak her just say, that that's really up to somebody else is an abdication of responsibility. >> michael, michael, you and i both know, being washington d.c. insiders, it has to be compromise. let's look at what boehner's offered, offered part of the simpson-bowles plan, not good enough. in the second part of the proposal he took part of what nancy pelosi offered may of this year to raise taxes of 1 million and above. what has the president offered? and basically jamie with both

proposals in ten years we're still going to have 21 trillion dollars worth of debt. >> jamie: angela. >> both proposals-- yes? >> not every republican agrees with speaker boehner on the compromise so there's pushback on both sides from democrats who control the senate and from the president and from some fellow residentiapublicans we taken a step back? i want to ask both of you, angela first. >> here is the rub, president obama knows nothing about being a great legislator and the tea party doesn't either. it's great to run on principle and sign a pledge you won't raise taxes, but in d.c., jamie, you have to compromise. ronald reagan figured that out, bill clinton figured that out, lbj was with the civil rights legislation figured that out. both sides need to come together again, it's on president obama, harry reid and the tea party. >> jamie: let's get michael in here. michael, at this point what can the president do? he's on vacation and the american people are wondering, they're selling off houses,

selling off stock. they don't know what next year looks like. >> in the interest of communication, not where the president is at christmas, but speaker boehner basically asked harry reid to figure out how to get a package that he can get 100 republican votes in the house of representatives on and harry reid is very good at figuring out the compromise that angela just talked about. i completely agree with angela's point, that the tea party has the speaker held hostage. a half dozen members or so, under no circumstances can we vote for taxes even on people over a million dollars, so i predict that we probably get over the cliff and that allows republicans to say, well, i only voted to cut taxes for 99%. i hope they get it done the second after it enacts so people don't feel it in their pocket books as they go into the new year. >> but, jamie, michael-- >> i have to leave it there. >> merry christmas. >> jamie: the president reiterated what he said even though he's on vacation he's on it. we will wait and see, happy holidays to both of you, merry christmas.

>> same to you. >> happy holidays to you. >> jamie: kelly? >> well, while folks are trying to dig their way out of the fiscal cliff, they're still trying to dig out of snow, serious snow out in the midwest after this week. in iowa, for example, crews across the region working to restore power to thousands of residents who lost their lights at the height of the storm. and record snowfall also taking place in green bay, wisconsin, packers fans helping to clear about 10 inches of snow from the bleachers at lambeau field ahead of sunday's game. that's a lot of fan support. and the storm forcing cancellation of 1400 flights ahead of the busy holiday travel weekend. some 500 of them at chicago's o'hare airport where things are just starting to get back on track. >> i know, i got lucky. think i got the last flight to st. louis until saturday or sunday. so, it just worked out. >> and i was stuck in

baltimore yesterday coming home from work and i was delayed there about four hours coming in tonight. so i was worried i wasn't going to make the flight. >> actually, very fortunate at the moment. and hearing that american airlines had 90 cancellations yesterday, i was actually kind of concerned mine was going to get canceled. >> kelly: all right, let's go to meteorologist maria molina live at the weather center. she can shed some light on the show. >> hay, kelly. good to see you. a lot of snow across portions of the midwest. the good news the storm system is final mri exly exiting the u some of that snowfall is still accumulating, talking additional one to three inches of snow, not a huge deal, again, compared to what we saw earlier this week, you see it here across parts of upstate new york and portions of central pennsylvania, even portions of the corridor, new york city and boston could see a couple of snow showers, no accumulation out here though so we're not really looking at any chances of a white

of the president and the democrats. and time is running out. will they come up with a solution? steve centanni is following this in washington. >> reporter: yeah, the fiscal cliff may be looming, but both sides have put negotiations on hold for now, to take a christmas holiday. no deal was reached this week to keep taxes from going up for everyone at the end of the year. house speaker john boehner, while saying he's still hopeful a sweeping deal can be reached, he's nonetheless, accusing the president of ignoring a huge problem here. >> this was the year of the size of our debt. all 16 trillion dollars surpassed the size of our entire economy. it's a grim many will have to bear if we don't come to grips with it. the president's solution of raising tax rates would still be red ink for as far as the eye can see he. >> reporter: president obama landed in hawaii this morning for a shorter than usual christmas break. and the white house yesterday, he said he thinks the comprehensive deal could still be reached, but at the same time, pushed for a scaled back

plan to cut taxes for the middle class. >> even though democrats and republicans are arguing about whether those rates should go up for the wealthiest individuals, all of us, every single one of us, agreed that tax rates shouldn't go up for the other 98% of americans, which includes 97% of small businesses. >> and the president said that tax cut is achievable in the next ten days. he also wants to preserve unemployment benefits for 2 million americans, now set to expire at the end of the year. >> jamie: thanks for the roundup. >> kelly: how will the looming fiscal cliff crisis affect you? well, if congress fails to reach a deal the beginning of the new year, those making between 40,000 and $50,000 a year will see an average tax increase of more than $1700. those making between 100,000 and $200,000 a year will see an average increase go even

>> and the fiscal cliff standoff taking a big toll on one of the key drivers of the economy, consumer confidence dropping to a five-month low. but at the same time,' same time, consumer spending was up a quarter of a percent last month according to the commerce department and we're seeing a big jump in personal income. so what does it mean and how do we compare it to the signals and what does it say about the health of our nation's economy.

joining us carolyn castlebury, good to see you. what does it hean when we see that the consumer's confidence is dropping and eroding and yet, spending is going up? >> it means that many of us feel bad, but the way we handle that is to shop. we want to spend anyway and actually, this was the indicator that went up in november, .4%, the the holidays are here, people want to forget about a lot of their problems and the one thing that americans are slow to give up on is hope and sometimes when that confidence wanes denial kicks in and one translation might mean jobs. >> kelly: just had a funny picture, shop till you drop no matter what's going on. that doesn't say much about our responsibility and accountability for our economic future? >> no, it doesn't. and we have to say in light of everything that's going on with capitol hill, watching the negotiations, all of these things that, you know, the consumers are definitely affected by this. there have been some positive signs on the economy, the

housing market has done better. manufacturing goods has shown some improvement. that's always a good indicator. so, really, you know, vaefr investors on our level are starting to tiptoe out of their cash accounts and look at this again and all of this is positive news on the economy. >> kelly: which means all is not lost. there's a hope that you speak of. carolyn, let me ask you, watching congress and the president battle what to do about the fiscal cliff, who is really in control hereof the people's money? we know what's going to happen if we go over the fiscal cliff, our economy is going to rise because of our taxes going up, but who is really in control of our personal expenditures and income? >> absolutely, kelly. you hit a key point and you are in control. i think along with that hope and that consumer confidence that we've been talking about, there is clearly fear with many consumers, people don't know what's going to happen with their income taxes and long-term capital gains. something that everybody needs to be aware of, alternative

minimum tax. this is something that people don't know that much about, but more than 30 million americans could get hit with this amt at about $3,000 extra on your tax bill. these are some of the things you need to sit down and be aware of and back to your point, kelly, that's up to you to take control. >> kelly: so, get educated. caroline, i wish we had more time to talk to you. that's a very he interesting topic there, amt and fear uncertainty and thank you for joining us, merry christmas. >> merry christmas. ♪ >> there's a new health warning to tell you about, a growing number of states are reporting the worst flu season in years and the f.d.a. has expanded its approval of the most widely described flu medication, tamiflu. you may have heard it. listen up, for children as young as two weeks old. our medical team is on.

dr. david somati, head of robotics at mount sinai medical center. we're going to put up the states that are reporting so far, the worst flu season. tamiflu for kids two weeks old? >> yes, this is big breaking news, but before we get to tamiflu, this is actually a very important information for people to know. typically, flu season starts around december, it peaks around january, february, it it may go on until march. and now it started in november. and there's about eight states that are actually indicating a high number of flu, this is quite dangerous. we know that during the flu season, hundreds and thousands of people actually get hospitalized, up to 49,000 people can die from this, so, it's very serious and it's a good time to remind people again, if you have not been vaccinated, go get your vaccination. all the myths about the fact that it's dangerous and side effects from it is probably not true. it takes about two weeks for people to build up the immune system, so, get vaccinated.

>> it's good to know it's not too late to get your vaccination. you know, i was thinking about it with a baby two weeks old. i was curious, are we born with some immunity or antibodies to fight off infection like the flu? >> yes, you get a lot of these antibodies from mom at birth. we have some builtup immune system for us. but familitamiflu was, two weekd older, in cases of children only works if you take it in the first 48 hours of symptoms and that's very important. anything more than that, it's not going to work and also, there are some concerns about the side effects. there were-- i looked up in the british system, side effects are higher than the benefits. we don't think that's the case. most of the side effects in kids are usually vomiting so you really want to run that by your doctor.

christmas and grammy winner jason crabb have been featured beyond the dream and join us to discuss how they're helping people in need this holiday season. jason and candy, glad to have you guys. >> thank you. >> candy you've been doing this for nine years now, and it started in nashville where you saw a tremendous need. 300,000 plus homeless people and could be understating it. >> 11,000. >> kelly: how many? >> 11,000 on the streets of nashville, yes. >> kelly: and what compels the country singer to go beyond her comfort zone to help people in need where it's not always comfortable? >> well, to me, kelly, it's one thing to write a check, to some unknown ministry somewhere else, but another thing to roll up your sleeves and really get involved with people and help in a tangible way and so, it started with meeting a need that i had, which i had depression so it

was a real feel-good thing to help people who would be eating out of a dumpster if i wasn't able to serve them. i was literally able to serve my way out of depression by serving others and a wonderful ride. >> kelly: it's a good way for healing. and jason, you and i have talked before there's a need and you have your grammy, and you have rolled up your sleeves and helping people so desperately in need, why? >> well, you know, that's just, that's just part of our fabric, but you know, i can one of the things this time of year and it's easy to do that, but candy, here, she does it every day, you know, and bridge ministry, and i don't know, people like her challenge me and to do better, to be, you know, to give more. there's a scripture that says

let's just give much is required and you know what, i feel like i'm one of the most blessed people on the planet and don't deserve it and i want to bless back. and maybe this stage. god gives awe stage to help others or maybe he helps you, you know, reach a place to where, you know, somebody will listen, to be able to help others. and so, i know, i'm just so delighted about today. >> candy, i was moved last year when i was there visiting you at your nashville center of operations, and first of all, you were given a massive warehouse to go out and meet the need. tell me what you'll be doing today and providing those supplies to so many people in need. >> well, we have rented the nashville municipal auditorium and we have ricky scaggs and many other gospel and country artists coming and we'll be contributing 2000 sleeping bags, almost 6,000 toys to

homeless and underprivileged children, we will distribute two tractor-trailer loads of food, nonperishable and perishable items today and soul for soul has partnered with us to distribute shoes, these kind of shoes. >> kelly: good shoes. >> hundreds of toys-- they're great, great shoes, we have a couple thousand sleeping bags, 5,000 blankets, and the homeless are going to have a wonderful, wonderful christmas. kelly, i read a story in luke, chapter 14 about a man who prepared a banquet and he invited all of his friends to come and no one would come because they were too busy. >> oh, wow. >> so he said, go out into the highways and hedges and you get the lame and the poor and the hall and bring them in that my house can be full. so, we just started with everyone in need in nashville and we've prepared a banquet for them. they are the guests of honor, they have the v.i.p. sitting.
